Key Questions and Answers about Trump’s Cuba Policy

1.  What changes did Trump actually make on June 16th, 2017 related to Cuba travel?

 

Sadly, Trump cancelled the popular individual self-directed general license category of people-to-people travel that was part of Obama's administration. Many of thousands of Americans used this license to visit Cuba in 2016 and 2017.

 

Fortunately, Trump did not cancel people-to-people travel sponsored by authorized US tour operators. Americans can visit Cuba with family or friends on private or public tours if arranged by an authorized US-based tour operator and employs a representative of an authorized US-based tour operator to accompany the group for the duration of the tour. Educational travel for schools remains the same, it has not been cut.

 

Trump has prohibited American visitors from using hospitality services provided by the Cuban military, which manages many of the island’s hotels, restaurants and transportation resources.

 

2. How will I know if my travel dollars are going to the Cuban military?

 

The US State Department will publish a list of Cuban entities with which “direct transactions are generally prohibited.” If you travel with an authorized US tour operator, they assume responsibility for compliance. Contact EAC Tours for an update on which hotels are off limits for Americans. 

 

3.  When will Trump’s June 16, 2107 changes be implemented?

 

The Department of the Treasury Office of Foreign Assets Control (OFAC) has 90 days to draft, adopt and issue the new regulations.

 

4.  I self-arranged independent travel before Trump’s rollbacks. Is my trip still legal?

 

No worries! Cuba travel arrangements booked prior to June 16, 2017 are not affected. Receipts of air, accommodations, etc. may be required. One can visit Cuba independently if authorized, licensed and hosted by an approved US tour operator. You can visit Cuba exclusively with a companion, family or friends. 

5.  What about group travel? How do I find those tours?

6. How do I choose a legitimate U.S. Cuba tour operator? 

 Please review these few key considerations for how to pick a legal Cuba tour operator:

  • Ensure the tour operator is located in the United States. It is illegal to purchase Cuba tour services from companies not incorporated in the US.                                    

  • The tour operator must provide documentation showing they are authorized to conduct people-to-people Cuba tours under US Department of the Treasury, Office of Foreign Assets Control (OFAC) regulations, Section, 1 C.F.R. § 515.565(b).                   

  • The US tour operator MUST issue an Authorization Letter and a copy of the OFAC License to each traveler.                                                                                                                                              

  • Find out how many years the American tour operator has been arranging Cuba tours and require the US operator to provide the legal documentation.                        

  • Make the US tour operator prove they are not using, or that they are exempted and able to use, Cuban entities proscribed by Trump, such as Cuban military owned services.                                                                                                                               

  • Ask EAC Tours for a list of suggestions and  recommendations.

 

7. Can I purchase an airline ticket and a Cuban Tourist Visa to come to Cuba?

 

Americans can continue to purchase air tickets and Cuba Tourist Visas for all categories of authorized travel.

 

8.  Can I still take a cruise ship to Cuba?

 

Yes.

 

9.  Can I bring home Cuban souvenirs, rum and cigars?

 

Yes. There are no spending limits while in Cuba or on the value of items you can bring home for personal use including rum and cigars but are subject to US customs duties.

 

10.  Will Trump’s Cuba travel rules be enforced?

 

YES. This is probably the most important question. Trump has directed his Department of the Treasury to “stringently” audit American travelers likely resulting in more scrutiny at US airports from immigrations and customs agents, and increased post-travel record requests. Travelers must declare an approved OFAC travel category*, maintain a full schedule of licensable activities in Cuba and keep trip records for five years. US tour operators maintain these records for their US travelers and provide certification of authorized Cuba travel.
